Platform Terms of Use

These Poshium Technologies Platform Terms of Use (these “Terms of Use”) set out the rules for using the platform available at www.poshiumgallery.com and through any Poshium mobile application made available from time to time (together, the “Platform”), along with any information, content, or materials published on or made available through the Platform (together, the “Content”).
These Terms of Use govern, and apply to, access to and use of the Platform and its Content by every visitor to the Platform (“you” or “your”).
The Platform is owned and operated by Poshium Technologies (“Poshium”, “we”, “our”, or “us”), with a registered address at Halifax, Nova Scotia, Canada.
You can contact us about these Terms of Use, or anything else relating to your use of the Platform, by emailing support@poshiumgallery.com.
By accessing or continuing to use the Platform, you confirm that you accept these Terms of Use and agree that they govern your access to, and use of, the Platform and all Content.
These Terms of Use form a legally binding agreement between you and Poshium. If you are using the Platform on behalf of a business or other entity, you confirm that you have the authority to bind that entity to these Terms of Use.
If you do not agree to these Terms of Use, you must not access or use the Platform, and should stop doing so immediately.
We may update these Terms of Use from time to time, with or without advance notice. The current version will always be posted on this page. Where a change is material and you hold a registered account, we will make reasonable efforts to notify you (for example, by email) where we are required to do so by law.
Please check these Terms of Use periodically so you understand the terms that apply to your use of the Platform at any given time.
We may change how the Platform works, or change any Content, at any time and without notice — for example, to reflect new features, changes in technology or market practice, applicable law, or our business priorities.
We do not guarantee that the Platform, or any part of it, will always be available, free of charge, or fault-free. We may suspend, withdraw, or restrict access to all or part of the Platform for operational or business reasons, including maintenance.
Our separate Privacy Policy explains how we collect, use, and share your personal information in connection with your use of the Platform, in accordance with applicable Canadian privacy law (including PIPEDA and any applicable Nova Scotia legislation). Please review it alongside these Terms of Use.
Subject to your ongoing compliance with these Terms of Use, Poshium grants you a personal, limited, revocable, non-exclusive, and non-transferable right to access and use the Platform and Content.
You may print one (1) copy, and download extracts, of pages from the Platform for your own personal, non-commercial use, and you may point others to Content on the Platform. You must not alter any copy you print or download, and you must not use images, photos, video, audio, or graphics separately from the surrounding text. You must not use any part of the Content for a commercial purpose without our prior written permission.
Poshium owns, or holds a licence to, all intellectual property rights in the Platform and its Content, including all design, text, graphics, and their selection and arrangement. The Platform and Content are protected under Canadian and international copyright and other intellectual property laws. All such rights are reserved.
All trademarks, logos, trade dress, and service marks shown on the Platform (“Marks”) belong to Poshium or to relevant third parties. You may not use any Mark without our, or the relevant owner’s, prior written consent.
You must not:
We may report breaches of these restrictions to law enforcement and will cooperate with any resulting investigation, including by disclosing your identity where legally required.
You can browse parts of the Platform as a guest, but you will need to register an account (“Account”) to access certain features, such as posting a Listing. You must provide accurate information during registration.
If any information you provided becomes inaccurate or out of date, you must update it promptly.
You may request deletion of your Account at any time by emailing [Insert Support Email].
You are responsible for keeping your login credentials confidential and for all activity that takes place under your Account. Notify us immediately if you suspect unauthorized use of your Account.
Poshium may offer paid features on the Platform from time to time (“Paid Services”) — for example, to feature a Listing more prominently in search results.
In relation to each Paid Service, you acknowledge that:
The Platform allows a user offering an item, property, vehicle, job, service, or experience (a “Seller”) to advertise it (each, a “Listing”) to other users. An interested user (a “Buyer”) may then contact the Seller through the Listing.
Poshium may, from time to time, offer a feature that uses artificial intelligence to help auto-complete a Listing. This feature is offered purely for your convenience and may not always produce accurate or complete results. You are responsible for checking and correcting any AI-generated content before publishing your Listing. Poshium accepts no liability arising from your use of this feature.
You acknowledge that Poshium has no obligation to monitor, vet, or approve Listings before they are published, and that we are not responsible for their content or accuracy.
If you buy an item or service through the Platform, you are contracting with the Seller who posted the Listing — Poshium is not a party to that transaction.
Although we are not responsible for Listings, we may monitor them and remove any Listing that, in our reasonable opinion, breaches these Terms of Use (including the Acceptable Use Policy).
Poshium may allow users to rate and review their dealings with other users (each, a “Review”), and to respond to Reviews they receive, in order to build trust and transparency on the Platform.
Every Review must comply with these Terms of Use and our Acceptable Use Policy. In addition, a Review must:
By posting a Review, you confirm that the views expressed are your own. Reviews are not endorsed by, and do not reflect the opinions of, Poshium, and we accept no liability for any Review — responsibility remains solely with the reviewer.
We may monitor Reviews and remove any that, in our opinion, breach these Terms of Use.
Any content you upload to the Platform, including as part of a Listing, is treated as non-confidential and non-proprietary as between you and other users.
You keep ownership of your content, but you grant Poshium a worldwide, royalty-free, transferable licence to host, use, reproduce, distribute, display, and create derivative works from that content, for as long as reasonably necessary to operate and promote the Platform and the specific Listing or feature it relates to.
You are solely responsible for backing up your own content. We may disclose your identity to a third party who claims your content infringes their intellectual property or privacy rights.
We may remove any content that, in our reasonable opinion, does not comply with these Terms of Use, with or without notice.
Whenever you upload content or contact another user through the Platform, you must comply with our Acceptable Use Policy. You confirm that your content complies with that policy, and you agree to indemnify us for any loss we suffer as a result of your breach of that confirmation.
We may collect payments from you through the Platform, including for Paid Services. By providing payment details at checkout, you authorize us (acting through our payment processor) to charge that payment method for the amount shown at checkout.
We are not responsible for losses arising from insufficient funds on your chosen payment method.
Refunds, where owed, will be issued to the original payment method. Once we provide proof that a refund has been processed, we will have satisfied our refund obligation; any further delay in you accessing the funds (for example, because a card is no longer active) is a matter between you and your bank or payment provider.
If your original payment method is no longer valid, notify us before we initiate the refund and provide satisfactory evidence of an alternative method; we may decline to use an alternative method if the evidence provided is insufficient or non-compliant with applicable law.
Nothing in these Terms of Use excludes or limits our liability where it would be unlawful to do so under the laws of Nova Scotia or Canada, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded under Nova Scotia’s Consumer Protection Act.
Subject to the above:
Subject to the first paragraph of this section, our total liability to you arising out of or in connection with your use of the Platform or these Terms of Use, however arising, will not exceed the greater of: (i) the amount you paid us for the Paid Service giving rise to the claim (if any); or (ii) one hundred Canadian dollars (CAD $100).
Where we reasonably consider that you have breached these Terms of Use, we may take any action we consider appropriate, including suspending or terminating your access to the Platform, closing your Account, removing your Content or Listings, and/or pursuing legal action.
If you believe any Content on the Platform is illegal, contact us at [Insert Support Email] with full details.
If you are an intellectual-property rights holder, or an authorized agent, and believe Content infringes those rights, notify us at [Insert Support Email] with full details of the alleged infringement. We will use reasonable efforts to remove infringing Content within a reasonable time.
Links to other websites or third-party content (including within Listings) are provided for your convenience only and are not an endorsement by us. We have no control over, and accept no liability for, third-party sites.
You may link to the Platform provided you do so fairly, legally, and without damaging our reputation, and without framing the Platform on another site or implying an endorsement that does not exist. We may withdraw permission to link at any time.
We do not guarantee the Platform will be secure or free of bugs or viruses. You are responsible for configuring your own device securely, including using appropriate virus protection.
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control (a “Force Majeure Event”). Our obligations are suspended for the duration of the Force Majeure Event, and we will use reasonable efforts to bring it to an end.
These Terms of Use apply in addition to any other agreement you may have with Poshium. Where there is a conflict, these Terms of Use prevail, but only to the extent of that conflict.
We may transfer our rights and obligations under these Terms of Use to another organization, and will notify you in writing if we do; this will not affect your rights under these Terms of Use.
These Terms of Use are between you and Poshium only. No other person has any right to enforce any part of them.
If we do not immediately insist that you comply with these Terms of Use, or delay taking action over a breach, that does not mean you no longer have to comply, and it does not stop us taking action later.
If a court finds part of these Terms of Use unlawful, the rest will remain in full force and effect.
The Platform is directed at users in Canada. We do not represent that the Platform or Content is appropriate, available, or compliant with local law in any other jurisdiction, and if you access the Platform from outside Canada, you do so on your own initiative and are responsible for compliance with local law.
Where these Terms of Use are translated into another language and there is a conflict with the English version, the English version prevails to the fullest extent permitted by law.
If a dispute arises, we encourage you to contact us first at [Insert Support Email] so we can try to resolve it directly.
If a dispute cannot be resolved amicably, these Terms of Use, their subject matter, and their formation (including any non-contractual disputes) are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable in Nova Scotia. You agree that the courts of Nova Scotia will have exclusive jurisdiction over any dispute or claim arising out of, or in connection with, your use of the Platform or these Terms of Use, subject to any mandatory consumer-protection rights you may have to bring proceedings in your own local court.
The Annexes below contain additional terms for specific parts of the Platform. They apply in addition to, and do not replace, the main body of these Terms of Use. If there is a conflict between the main body and an Annex, the Annex prevails for that specific feature.
The Real Estate section of the Platform lets property owners, brokers, agents, and developers advertise properties for sale or rent, and lets prospective buyers or tenants view listings, contact the advertiser, and arrange viewings.

You acknowledge that Poshium only provides a platform for advertisers to list properties, and is not itself a real estate broker. We do not verify the accuracy or completeness of property Listings — you should conduct your own due diligence and should not rely solely on a Listing’s contents.
The Automotive section lets Sellers advertise vehicles for sale and lets prospective Buyers view Listings and contact the Seller.
If you are a Seller, any vehicle you list must:
We may ask you to provide proof of ownership and/or proof of the vehicle’s location or customs clearance. If you do not provide this within a reasonable timeframe we specify, we may remove the Listing without notice or refund.
The Jobs section lets employers and recruiters advertise open positions, and lets job seekers apply.
Poshium is not responsible for information posted by job seekers, including their résumés or CVs, and does not guarantee the suitability of any candidate. Any CV search or database feature is a convenience tool only. Fees paid are non-refundable, including if you do not find a suitable candidate.
If you post a job-seeking listing, employers and recruiters using the Platform will be able to view your personal details and résumé. Any fees you pay are non-refundable, including if you do not secure a position.
This Annex governs bookings of short-term accommodation (“Properties”) advertised by independent hosts (“Hosts”) through the Travel & Hospitality section of the Platform (“Services”). It applies alongside the main Terms of Use.
All bookings (“Bookings”) are subject to availability and Host confirmation, unless the Host has enabled instant booking, in which case confirmation is automatic once payment succeeds. You agree to pay the listed price plus any applicable service fees, taxes, and other charges shown at checkout. Where you pay in a different currency than the one set by the Host, the displayed price reflects a conversion rate set by Poshium at the time of payment.
A Booking is a limited licence to occupy the Property for the agreed period. The Host may re-enter the Property where reasonably necessary, permitted by your agreement with the Host, and permitted by law. You must not exceed the maximum guest count for the Booking or overstay the agreed checkout time without the Host’s consent.
You may cancel a Booking within forty-eight (48) hours of making it, or any other cancellation window shown on the Platform at the time of booking (the “Cancellation Period”), unless a Host Cancellation Policy (below) says otherwise. Bookings made within forty-eight (48) hours of check-in are treated as last-minute and are non-refundable, except as required by law or under a Host Cancellation Policy.
Hosts may set their own cancellation policy (“Host Cancellation Policy”), which prevails over the standard Cancellation Period where it is shown on the Listing or otherwise provided before the Booking is confirmed. All time-based calculations use the time zone of the Property’s location, unless the Booking confirmation says otherwise.
If a Host cancels a confirmed Booking, you may be entitled to a refund under our cancellation policy or the applicable Host Cancellation Policy.
If you do not check in and do not respond to messages through the Platform for forty-eight (48) hours after your scheduled check-in time, the Host may report this as a no-show. We may then cancel the Booking, end your licence to occupy the Property, let the Host re-list it, and treat the cancellation as a no-show rather than a Host cancellation, generally without a refund, except where required by law or where we determine, at our discretion, that exceptional circumstances apply.
If a Property is not made available to you, is unsafe or unsanitary at check-in, or materially differs from its Listing (for example, the wrong room type, an undisclosed co-occupant, or a missing advertised amenity), report it to us within forty-eight (48) hours of discovery, with supporting evidence such as photos or messages.
You are responsible for your own conduct and that of any guest you bring, including leaving the Property as you found it, paying for any damage or loss you cause, following the Host’s house rules, and complying with the law. If you book for, or bring, a minor, you confirm you are authorized to act for them and are responsible for their supervision.
Poshium provides the Platform connecting guests and Hosts and is not a party to the contract between you and the Host, except as needed to facilitate the Booking and payment. We do not verify or guarantee the accuracy of Host-provided information, the outcome of any Booking, or a Host’s reliability. Our liability in connection with a Booking or stay is limited to the amount you paid for that Booking, except where caused by our gross negligence or where liability cannot be excluded by law.
Poshium may offer business users a “Verified Business Account” feature, letting you display a verified badge, business logo, description, and website link on your storefront and Listings. Perks may change over time and will be described on the Platform.
You may subscribe at any time by following the on-platform process. Your subscription begins once our verification is complete and renews monthly on the anniversary of your start date (“Billing Cycle”) until cancelled. Subscription pricing may change; we will notify you by email before any change takes effect. If you cancel, you keep access until the end of the current Billing Cycle.
Subscription fees are charged to your payment method at the start of each Billing Cycle through our third-party payment processor. If a charge fails, we may suspend the feature and/or your Account until payment is made.
To subscribe, you must provide a copy of your business licence or equivalent, and any further documents we reasonably request, and you confirm these are genuine and current.
The feature is intended to increase trust and visibility, but we make no guarantee about its effect on the success of your Listings.
We may modify or discontinue the feature at any time, with or without notice; if we discontinue it entirely, we will notify you by email and cancel your subscription automatically. You may cancel your own subscription at any time.
