Personal Information We Collect From You

“Personal information” means information about an identifiable individual. It does not include information that has been permanently de-identified so that no individual can be identified from it. It does include information that, alone, may not identify you, but could identify you when combined with other information.

If you use vehicle-related features (such as arranging a test drive through the Automotive category), your driver’s licence and ID details.

Contact Data

Your email address and phone number(s).

Location Data

Your approximate location, if you enable location sharing on your device.

Listings Data

Details of your current and past Listings, Listings you’ve viewed, and offers you’ve made on other users’ Listings.

Marketing Data

Your preferences for receiving marketing messages from us.

Chat Data

Messages you exchange with other users through the Platform’s chat feature, including any personal information you choose to share in those messages.

Call Data

Recordings of calls between you and our support team, made for training and quality purposes, where applicable.

Behavioural Data

Information we infer about your interests and behaviour based on your activity on the Platform, typically grouped into aggregated segments.

Technical Data

Your IP address, login data, browser type and version, time zone, device type, operating system, and similar technical information.

Communication Data

Messages, images, and documents you exchange with our team through channels such as email or WhatsApp.

Aggregated data

We also use aggregated data — for example, statistics about how many users access a particular feature. Aggregated data does not identify you and is not personal information. If we ever combine aggregated data with other information in a way that could identify you, we treat the combined data as personal information under this Privacy Policy.

Sensitive information

We do not intentionally collect sensitive personal information about you, such as details of your race or ethnicity, religious beliefs, political opinions, health information, genetic or biometric data, or criminal record information.

Please do not share this type of information with us (for example, through our support chat) or with other users (for example, through in-Platform messaging). If you choose to share it anyway, you consent to us handling it in accordance with this Privacy Policy.

What if you don’t want to provide personal information?

You’re not obligated to give us personal information. However, if certain information is necessary for us to provide you with access to the Platform or to meet a legal obligation, and you choose not to provide it, we may not be able to give you access to that part of the Platform. For example, we need your email address to create an account for you.

Other Platform users

We share relevant information (such as your username, profile photo, and Verified status) when you transact with another user. Anything you post in a Listing or Review — including any personal information you include — becomes publicly visible, may be copied or shared by others, and may appear in search engine results (e.g., Google). Please only share information you’re comfortable making public.

Service providers

Companies that help us run the Platform, such as IT hosting, payment processing, and marketing service providers, may access your personal information as needed to perform their services.

Our affiliates

If Poshium operates or partners with related companies or shares technology with them, those affiliates may need access to your personal information to help operate the Platform.

Professional advisers

Our lawyers, accountants, bankers, insurers, and similar advisers may need limited access to your personal information to provide their services to us.

Public authorities

We may be required to disclose personal information to a court, regulator, or law enforcement body where the law requires it.

A buyer of our business

If Poshium is involved in a merger, acquisition, financing, or sale of assets, your personal information may be shared with the parties involved, subject to it continuing to be used in accordance with this Privacy Policy.

Your personal information may be stored or processed outside of Canada, including in countries whose privacy laws may differ from Canada’s. How to exercise your rights

We may ask you to verify your identity before acting on your request, as a safeguard to prevent disclosing your information to the wrong person. We aim to respond within 30 days; if a request is complex, we’ll let you know and provide a revised timeline.

We generally do not charge a fee to respond to a request, but Canadian privacy law permits us to charge a reasonable fee in some circumstances (for example, for repeated or excessive requests), and we will always notify you in advance if a fee applies.

Complaints

If you have a concern about how we’ve handled your personal information, please contact us first at privacy@poshiumgallery.com so we can try to resolve it. If you remain unsatisfied, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca).

Marketing Communications

You can opt out of marketing messages at any time by updating your notification preferences in your account settings, or by clicking “Unsubscribe” at the bottom of any marketing email. Where we send commercial electronic messages, we do so in accordance with Canada’s Anti-Spam Legislation (CASL), including honouring unsubscribe requests promptly.

Our Policy on Minors

The Platform is intended for users who have reached the age of majority in their province or territory (nineteen (19) in Nova Scotia), and we do not knowingly collect personal information from minors.

Third-Party Links

The Platform may contain links to third-party websites or apps.
